What does a Local Land Charge search cover and include?

The search reveals all information held on the statutory Local Land Charges Register, such as Tree Preservation Orders, Enforcement Notices, Legal Agreements (such as Section 52 or Section 106 agreements), Listed Building or Conservation Area notices and Public Health notices or any other document containing local authority imposed conditions or restrictions.
A Local Land Charges Search also includes details effecting each particular property or piece of land by four other departments: Planning, Building Control, Environmental Health and Highways.

What is the difference between a Local Authority Certificated Search and a Personal Search?

The Local Authority is the only source for an official certificated search. The Con29 forms used for searches are completed by fully trained and experienced staff in each of the relevant sections: Local Land Charges, Planning, Building Control, Environmental Health and Highways.
A personal search can be carried out by the home mover themselves, or by a private personal search agent or company. With a personal search, the person undertaking the search has access to inspect the Local Land Charges Registers.
A personal search does not include the Con29 form information and is not certified, unless this is requested at an additional cost by the person or company performing the search. Personal search companies may use their insurance as cover for information they do not or cannot provide a response to.

What information do I need to supply for you to carry out a search?

  • Completed LLC1 and Con29 forms (2 copies).
  • Ordnance Survey Plan outlining the property at 1:1250 or 1:2500 scale (2 copies).
  • A cheque for the required amount, made payable to Horsham District Council.

What forms should I submit?

Searches must be submitted on the LLC1 and the CON29 forms agreed by the Law Society and the Local Government Association.  The Council does not provide copies of the forms: these are available from legal stationers.  Any combination of the forms may be submitted. 

LLC 1 form

The LLC1 form is the official requisition of search of the Local Land Charges Register, which discloses the registered entries affecting the property. These may be conditional planning consents, conservation areas, tree preservation orders, Council grants that may need to be repaid, agreements or identification of the property as a building of special architectural or historical interest,etc.

The CON29 (R) Required form

The CON29 (R) Required form has a number of set questions that are asked, these cover such matters as highway adoption and road schemes, local plan policies, environmental health notices, building control applications, planning notices and orders,etc.

The CON29 (O) Optional Form

It is also possible to ask additional questions, which are set out on the CON29 (O) Optional form. These are the additional questions numbered from 4 - 22, ranging from Road Proposals, Advertisements, Pipelines etc. 

As well as the set additional questions it is possible to make your own question, such as information concerning recent planning applications on adjoining properties.

What kind of follow up services do you provide after the search is complete?

A search is only a statement of the information held up to and including the date it is issued. We offer a free refresher search on any full search carried out, for up to 3 months from the submission of the original search.
From 4 to 12 months after a full search, a refresher search is provided at a fee of £35. There is no need to resubmit a new full search on the same property.

Can I submit a search online for an even faster turnaround?

Yes. We work alongside the National Land Information Service (NLIS), the leader in the provision of electronic local authority property searches across England and Wales to accept searches electronically online.
Go to http://www.nlis.org.uk/ for information on how to submit your searches via them electronically.
Currently, all of our searches are returned via post, though we are moving towards providing electronic returns in the near future.

Can I cancel a search?

If a search has been received but not yet entered in our system and sent out to each of the contributing departments, it can be cancelled and the fee and search returned. After this time, it cannot be cancelled, and the fee cannot be returned or refunded.

How do I obtain copies of documents detailed in the Local Land Charge Search?

Providing the document required is listed in the Search as being held by Horsham District Council, you can write to us to request a copy.  Otherwise you should contact direct the organisation as listed in the Search.
