HDC SUPPLIER TERMS AND CONDITIONS

  1. If it becomes apparent that the maximum value of this order, as stated above, is likely to be exceeded, the supplier must immediately contact the ordering officer for further instructions.

  2. All goods to be despatched, carriage paid, and accompanied by a delivery note quoting name of the addressee.

  3. Deliveries should be made between 9 a.m. and 4 p.m. on normal working days.

  4. A valid VAT invoice should be submitted as soon as possible after completion of the order.

  5. No goods or services must be supplied or works carried out without an official order form.

  6. The Council may cancel this contract in the event of corruption and may recover from the contractor any loss resulting from such cancellation.

  7. The contractor shall, in providing the services, supplies or works, comply with all current legislation relating to health and safety at work, sex, race and disability discrimination.

  8. The Sale of Goods Act 1979 (as amended) applies to the sale of goods under this contract and the Supply of Goods and Services Act 1982 (as amended) applies to the supply of goods and services under this contract.

  9. The Contractor warrants that the services, supplies or works are fit for the purpose, comply with appropriate British or European Standards, will not be affected as to performance and/or functionality by date or other information technology functions, comply with the Council’s environmental and sustainability policies as may have been notified to the Contractor.

  10. The Contractor agrees pursuant to the Data Protection Act 1998 to the Council’s using any information arising from under this contract for any of its statutory purposes including in particular the prevention or detection of fraud.

  11. The Contractor shall supply to the Council such information as the Council shall require to enable it fully and properly to comply with requests for information under the Data Protection Act 1998 and the Freedom of Information Act 2000 and to handle enquiries by the Council’s Scrutiny and overview and Standards Committees, the Standards Board for England, the Local Government Ombudsman, the Council’s internal and external auditors, Government Departments, the European Commission and other legally empowered persons.

  12. The acceptance of this order will be regarded as agreement to comply with these conditions.
