Conditions for busking on the highway

The following conditions apply to anyone busking on the highway in Horsham District.

  1. The performance shall be carried out so as to cause no danger or annoyance to any member of the public or occupier of adjoining property.
  2. Neither the promoter nor anyone associated with the event/activity shall cause any obstruction either to members of the public or to private premises.
  3. The performer shall indemnify and keep indemnified the Council against any actions, proceeding, claims damages and liabilities which may be taken, made or incurred, consequent upon, or arising in connection with the performance.
  4. Performances shall not be carried out within 100 metres of another performer or event.
  5. Performances shall not be carried out for more than half-an-hour in one location. At the end a performance (of whatever duration) the performer shall move on to another location not less than 25 metres from that location.
  6. The performer shall stop the performance immediately if complaints are received or if instructed to do so by an authorised officer of the Council or a police officer.
  7. No stand, stall or similar structure shall be brought onto or allowed to stand on any part of the highway, nor shall any motor vehicle be allowed to drive or stand on any footway or to enter any pedestrianised area.
  8. Neither the promoter nor anyone associated with the event/activity shall offer or expose for sale or sell any goods without a street trading licence or consent issued by the Council in respect of street trading or a street collection, house to house collection licence or public charitable permit issued by the Council in respect of charitable collections or a pedlar's certificate (as the case may be).
  9. Neither the promoter nor anyone associated with the event/activity shall collect any money for a charitable or other organisation without a street collection permit, house to house collection licence or charitable collection permit issued by the Council.
  10. Any amplification shall be kept to a level sufficient to comply with the Council's Good Rule Government Byelaws and the Environmental Protection Act 1990 (as amended) and shall be adjusted in accordance with any requirement of an authorised officer of the Council or a police officer.
  11. If the Council received justified noise complaints about a busker or street musician and are of the opinion that the person is causing a Noise Nuisance, that person will be served with a Noise Abatement Notice under Section 80 of the Environmental Protection Act 1990. Failure to comply with the requirements of the Notice is a criminal offence and it is our policy to pursue such matters vigorously. This may result in equipment (eg. musical instruments, amplifiers and microphones) being temporarily confiscated in order to secure compliance. Offenders also risk prosecution and a substantial fine.
  12. Buskers are required to wear or display their badges at all times.
